Multiple states in the U.S. are enacting Extended Producer Responsibility (EPR) laws, holding producers of packaging responsible for the full life cycles of their products. Seven states have EPR laws, with six already requiring annual reporting. In addition, EPR requires participation in a Producer Responsibility Organization and paying fees to fund collection, sorting, recycling, and disposal of packaging to reduce the burden on municipalities.
Failure to comply with any phase of EPR programs, from registration to reporting and fee payment, can result in an array of consequences all the way up to monetary fines up to $50,000 dollars. Noncompliance notices are already going out with enforcement coming soon.
